STATE COMMITTEE ON STANDARDIZATION, METROLOGY AND PATENTS OF AZERBAIJAN REPUBLIC

The establishment of the Agency

In 1906 by the decision of Baku City Administration the testing booth No. 25, having the staff of 4 persons has been established. This date is considered as the date of establishment of the State Agency on Standardization, Metrology and Patents of the Republic of Azerbaijan.

The State Agency on Standardization, Metrology and Patents of the Republic of Azerbaijan has been established in accordance with the Decree No. 623 of December 27, 2001 of the President of the Republic of Azerbaijan Heydar Aliyev.

The Duties of the Agency

- to implement the state policy in the field of standardization, metrology, certification and protection of objects of the industrial property;

- to form the basic directions of a state policy, prepare and provide implementation of target programs, coordinate activities of other state bodies and institutions of local governing, economic subjects in the above-mentioned fields;

- for the purpose of observance of requirements of standardization and metrology, to take measures of the state control;

- to provide unity of means of measurements;

- to organize works on protection of objects of the industrial property;

- in order to increase the competitiveness and quality of the goods (works, services) made in the territory of the Republic of Azerbaijan, to update normative documents in the field of standardization, metrology, certification and protection of objects of the industrial property, uniting in themselves modern scientific and technical potential and the advanced international practice, and take measures on providing their conformity to modern international practice;

- in accordance with procedure provided for in the legislation, to implement the state control over the conformity of imported (put into free circulation) and exported goods (works, services) to the requirements of standards, metrological rules and norms, rules of certification and protection of industrial property objects;

- to implement the necessary measures in the sphere of application of appropriate international standards in the Republic of Azerbaijan;

- to implement the other duties provided for in the legislation of the Republic of Azerbaijan.>

The Rights of the Agency

- to adopt legal acts within its competence and in accordance with established procedure;

- within its competence make decisions that are compulsory to execution for central and local executive authorities, municipalities, natural and legal persons of the Republic of Azerbaijan;

- within its competence and in accordance with established procedure to get the necessary information and references from central and local executive authorities, municipalities, natural and legal persons of the Republic of Azerbaijan;

- in accordance with procedure established by legislation, to attract local and foreign experts, advisers, conclude agreements (contracts) with them for preparation and execution of issues within the competence of the Agency;

- within its competence to cooperate with state bodies and legal persons, international organizations, prepare the drafts of international agreements;

- to prepare the experts in the field of standardization, metrology, certification and protection of the industrial property objects, take measures on improvement of professional skills and cooperate with the international organizations in this field;

- to establish the enterprises and organizations in accordance with the legislation, reestablish and liquidate them;

- in accordance with the procedure established by the legislation, to establish periodical press organs, issue special bulletins and other editions and organize their sale;

- to coordinate the control activities of state executive bodies over the quality and safety of the goods (works, services);

- to get freely to the service and production fields of economic subjects, objects where means of measurements are used, made, repaired, on sale or stored; receive the necessary information and documents from them, use experts, material and technical means of economic subjects gratuitously in order to implement the state control over the fields within its competence;

- according to the existing normative documents in the field of standardization for determination of conformity of the goods, works and services to the requirements of standards gratuitously select probes for testing;

- within its competence and according to the established procedure during implementation of the state control over observance of requirements of standards, rules of certification, rules and norms of metrology in the cases stipulated by the legislation to make demands, instructions, administrative penalties and apply financial sanctions;

- in case of when products (processes, services) that may endanger human life, health and property, as well as the environment are not in line with the requirements of standards, to issue written request providing suspension or prohibition of their production, implementation or use, withdrawal from circulation (sale) or return from consumers, make a decision on the prohibition of sale, participate in the process of withdrawal from circulation of products (if necessary, liquidation or utilization) that are not in line with the requirements of standards together with relevant executive bodies;

- in the cases reflected in the legislation to conduct paid works and render services on standardization, metrology, certification, accreditation and protection of industrial property objects on the basis of concluded agreements;

- to finance the measures for the development of processes in the fields of standardization, metrology, certification and protection of industrial property objects;

- for the protection of consumers’ rights to obtain detailed information about natural and legal persons (economic subjects) operating in the country, do joint work with appropriate state bodies for the determination of producers of low-quality and not responding to the requirements of standards;

- to bring a suit in the appropriate courts regarding the issues under its authority;

to exercise other rights provided by the legislation.

International Relations

- After the Republic of Azerbaijan declared its independence, the State Agency on Standardization, Metrology and Patents within its competence with a view of human life, health and environment protection and protection of the consumers’ rights conducted close cooperation with many international and regional organizations (ISO, ECO, WIPO) during this period.

- Since July 1, 2003 the Agency officially is a member body of the International Standardization Organization (ISO). During this period the Agency gets detailed information about the activities in the national standardization organizations in the ISO’s member countries and productive discussions are carried out in the given fields.

- Since November 28, 1992 the Republic of Azerbaijan is a member of the Economic Cooperation Organization (ECO). Azerbaijan plays an important role in this regional organization. The corresponding works are carried out by the Agency, intergovernmental relations are constantly supported, the exchange of opinions among the national standardization organizations of the member countries is carried out, information exchange is organized and useful discussions about processes occurring in the world in these fields are carried out.

- The Agency closely cooperates with the World Intellectual Property Organization (WIPO):

- Since 1995 up to now the Republic of Azerbaijan has joined 8 conventions, treaties and agreements of the World Intellectual Property Organization (WIPO) in the field of protection of the industrial property:

8. The Nice Agreement on International Classification of Goods and Services for Registration Marks
